Terms & Conditions

Effective Date: 17/09/2026

These Terms & Conditions apply to all purchases of furniture and related products made through Heatherdales (“we”, “us”, “our”) and our website.

By placing an order with us, you acknowledge that you have read and accepted these Terms & Conditions.

1. ABOUT OUR FURNITURE

Our furniture is carefully handmade and manufactured to order. Because our products are handmade, minor variations in measurements, stitching, grain, texture, colour and finish may occur.

These natural variations are not considered defects and are part of the character of handmade furniture.

Where applicable, product photographs are for illustration purposes. Colours may appear slightly different depending on lighting, photography and the screen or device being used.

2. ORDERS

An order will only be regarded as confirmed once we have received the required deposit or full payment, as applicable, and the order has been confirmed in writing by us.

Customers are responsible for checking all details on their quotation or order confirmation before production begins, including:

– Product and design
– Measurements
– Fabric, colour and finish
– Quantity
– Configuration
– Special requirements
– Delivery address

Once production has commenced, changes to an order may not be possible and may result in additional costs or delays.

3. CUSTOM AND MADE-TO-ORDER FURNITURE

Many of our products are made specifically for the customer.

Custom-made or personalised furniture may include furniture manufactured to specific measurements, fabric selections, colours, finishes, designs or other customer requirements.

Where a product is made specifically to the customer’s specifications, cancellation or return may be subject to applicable consumer law and the specific circumstances of the order.

We will discuss any applicable cancellation, alteration or refund with the customer before proceeding.

4. PRICING

All prices displayed on our website are subject to change without prior notice.

The price applicable to an order is the price confirmed in the customer’s quotation or order confirmation.

Where a quotation has been issued, the validity period of that quotation will be stated on the quotation.

Additional costs may apply for customised designs, special materials, unusual dimensions, additional upholstery requirements or other changes requested by the customer.

5. PAYMENT

A deposit or full payment may be required before production begins, depending on the order.

The balance, where applicable, must be paid in full before delivery or collection unless otherwise agreed in writing.

We reserve the right to delay production or delivery until required payments have been received.

6. PRODUCTION LEAD TIMES

Our furniture is handmade and production times may vary depending on the product, materials, customisation and current production schedule.

Estimated lead times will be communicated to the customer when the order is placed.

Estimated production times are not guaranteed delivery dates unless specifically agreed in writing.

Delays caused by circumstances outside our reasonable control, including supplier delays, material shortages, transport disruptions or other unforeseen circumstances, may affect the estimated completion date.

We will make reasonable efforts to keep customers informed of significant delays.

7. FABRIC, COLOUR AND MATERIAL VARIATIONS

Customers are responsible for approving their chosen fabric, colour, finish and other materials before production.

Natural materials such as genuine leather and timber may contain variations in grain, colour, texture and markings.

Fabric colours may also vary slightly between batches.

Where a customer supplies their own fabric or materials, we are not responsible for defects, colour variations or inconsistencies inherent in those materials.

8. MEASUREMENTS AND ACCESS

Customers are responsible for ensuring that furniture will fit through all relevant access points, including gates, doorways, passages, stairways, lifts and entrances.

This includes checking the dimensions of the furniture against the available access space before placing an order.

We cannot be held responsible for furniture being unable to access a property where adequate measurements or access information was not provided.

Where a delivery requires additional labour, disassembly, hoisting, special equipment or other arrangements, additional charges may apply.

9. DELIVERY

We currently offer reliable delivery services within Pretoria and Johannesburg, subject to availability.

Delivery fees depend on the delivery area and will be quoted separately or included in the customer’s quotation.

Delivery dates and times are arranged with the customer once the order is ready.

The customer must ensure that someone is available to receive the furniture at the agreed delivery time.

Additional delivery charges may apply where:

– Nobody is available to receive the order;
– Access to the property is restricted;
– Additional handling or labour is required;
– The delivery address changes after the order has been confirmed; or
– A second delivery attempt is required for reasons outside our control.

10. INSPECTION ON DELIVERY

Customers are encouraged to inspect their furniture upon delivery.

Any visible damage caused during transportation should be reported to us as soon as reasonably possible, together with photographs where applicable.

This does not limit any rights the customer may have under applicable consumer legislation.

11. RETURNS, REFUNDS AND DEFECTIVE PRODUCTS

We take care to manufacture furniture to the agreed specifications and quality standards.

Nothing in these Terms & Conditions is intended to exclude or limit any rights that a consumer has under the Consumer Protection Act or other applicable South African legislation.

Where furniture is defective, materially different from what was agreed, or otherwise subject to a valid statutory claim, the matter will be assessed and addressed in accordance with applicable law.

Depending on the circumstances and applicable legal requirements, the remedy may include repair, replacement or refund.

Furniture that has been damaged through misuse, negligence, incorrect assembly, improper care, normal wear and tear, exposure to unsuitable conditions or unauthorised modification may not qualify for a remedy.

12. CANCELLATIONS

Because many of our products are handmade and manufactured specifically for individual customers, cancellation requests should be made as soon as possible.

Once production or procurement of materials has commenced, cancellation may result in costs being incurred.

Any cancellation, refund or deduction will be dealt with in accordance with applicable consumer legislation and the circumstances of the order.

13. WARRANTIES

Where a separate warranty or care policy has been provided with the product, that document should be read together with these Terms & Conditions.

Our warranty does not replace or limit any statutory rights available to consumers under applicable South African law.

The warranty does not cover damage resulting from misuse, neglect, accidents, incorrect cleaning, unsuitable environmental conditions, unauthorised alterations or normal wear and tear, except where applicable law provides otherwise.

14. CARE OF FURNITURE

Customers are responsible for following the care instructions provided with their furniture.

Failure to follow recommended care instructions may affect the appearance and lifespan of the furniture and may affect warranty claims where permitted by law.

Specific care requirements may apply depending on the fabric, leather, timber or other material used.

15. WEBSITE INFORMATION

We make reasonable efforts to ensure that product descriptions, photographs, measurements and prices displayed on our website are accurate.

However, minor differences may occur due to handmade production, photography, screen settings, material batches and natural variations.

If an error is identified, we will take reasonable steps to correct it.

16. INTELLECTUAL PROPERTY

All photographs, product designs, descriptions, logos, graphics, branding and other content displayed on this website belong to or are licensed to [Business Name], unless otherwise stated.

No content may be copied, reproduced, modified or used commercially without our prior written permission.

Users agree not to misuse the website, interfere with its operation, attempt unauthorised access, or use the website for unlawful purposes.

We reserve the right to update, suspend or discontinue any part of the website where reasonably necessary.

18. LIMITATION OF LIABILITY

Nothing in these Terms & Conditions excludes or limits any liability or consumer right that cannot lawfully be excluded or limited under South African law.

Subject to applicable law, we will not be responsible for losses arising from circumstances beyond our reasonable control.

19. PRIVACY

Personal information provided to us will be handled in accordance with our Privacy Policy and applicable South African data-protection legislation.

Please refer to our Privacy Policy for further information regarding the collection, use and protection of personal information.

20. GOVERNING LAW

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law and the consumer’s applicable statutory rights.

21. CHANGES TO THESE TERMS

We reserve the right to update these Terms & Conditions from time to time.

The version published on our website will apply to future orders from the effective date stated above.
